Taking the stress out of TUPE school staff transfers -the Nirvana Way
In these unusual times, we have had the privilege of looking after so many schools that are doing a fantastic job looking after students, parents and staff both in-person and online.
We know our education colleagues have had to make many changes to the way they work. The Pandemic has also given us space and time to find new and better ways to provide our School Cleaning and Caretaking Services.
One of the critical challenges that our schools face is the transfer of staff from one employer to another when a service provision change takes place, and they ask us to provide their School Cleaning and Caretaking Services.
The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE Regulations) apply to most situations in which staff working in schools are transferred between employers.
TUPE is a complicated piece of legislation, and the transfer process must be conducted correctly. Headteachers and Governing Bodies must be aware of their responsibilities to ensure that the TUPE regulations’ requirements are met in any situation where employees can be transferred from one employer to another. We have many years of experience helping our schools through the staff transfer process and ensuring that all of their requirements are met, and the process is smooth and easy.
We look after schools across the Northwest of England, Chester, Widnes, Runcorn, Frodsham, Ellesmere Port, Manchester, Liverpool and North Wales.
We want to build on our experience and bring excellent service to many more schools in the Region.
Managing staff transfers TUPE and LGPS -the Nirvana way
We help you with formal consultation with employees and their representatives, provide accurate information about the employees to be transferred, and ensure that employees moving to us are supplied with an appropriate pension scheme, including staff with LGPS contributions ( a common barrier to changing provider).
We have been working with several Primary schools, Academies and Trusts in the area for many years. That gives us a wealth of experience in dealing with all the challenges of providing School Cleaning and Caretaking Services.
Where we have taken on TUPE contracts, we have made sure that it has been a very smooth process for the staff. As the law requires, we make sure everything stays the same for the employee, with TUPE rules being in place for over 12 months. This is a huge benefit for our clients as the same staff tend to stay on and ensure a continuity of service.
In our experience, this continuity, combined with our ISO 9001 Quality Management Systems and our innovative site management system, gives us the edge over our competitors.
Usually, its bad management by external providers that causes performance issues, not your cleaning and caretaking staff. We find that a sound management system and putting our people first delivers the very best service. We are not an agency, we value our staff and their development, and we know how vital retaining them as long term team members is.
Our service – the Nirvana way
At Nirvana, our School Cleaning and Caretaking Services offers schools all the benefits of an outsourced service with non of the downsides.
We provide full coverage, even when your caretaker or cleaner goes off sick. We provide services to our schools on a retainer basis. We are ISO 9001 Quality Management Systems accredited, and we agree our performance standards with you in a Service Level Agreement (SLA). As each SLA is bespoke, we agree on it with the school and include agreed standards and targets at the contract’s commencement.
Our service cuts down the employment costs to our schools and relieves them of managing the site’s cleaning and caretaking services.
We are not an agency, we value our staff and their development, and we know how vital retaining them as long term team members is.
We don’t like zero-hours contracts, so all staff are directly employed and contracted for a set number of hours, we pay more than the minimum wage, providing pensions and paid holiday.
We keep down admin costs by sending all our invoices digitally. All our quality checks and report documents are available in a customer portal accessed via a secure login.
Our staff come with all the relevant qualifications and are DBS and reference checked. If they are new, we provide a comprehensive training package before they start on site.
Long Term Partnership, Quality, Peace of Mind and Cost reduction- the Nirvana way
Long term partnerships are essential to us, and that’s how we have built the business in the last ten years.
We work hard on developing our people on-site to retain them and improve their skills. We find that’s the best way to provide outstanding service and reduce the number of contractors needed is to provide the service to a high standard. That means we can pass on a share of the cost savings too.
Above all, we aim to give our Schools peace of mind that there is a reliable, robust management system in place that keeps them safe and secure and saves the hassle, time and money.
